Terms and Conditions
1. Introduction:
1.1. When registering on www.tonybet.com, mobile application or any other websites or applications that Tonybet OÜ, owns or operates (“Website”) You (“You”, “Your”, “Yourself”, or “User”,” interchangeably) enter into an agreement with Tonybet OÜ a company registered in Estonia, having its company number 12103082 and registered office situated at Parnu mnt 31-53, 10119, Tallinn, Estonia (“Tonybet”, “our”) and is Licenced and regulated in Kahnawake by The Kahnawake Gaming Commission. Licence number No. 00902, Estonia by the Estonian Tax and Customs Board. Licence numbers are HKL000393, HKT000016, HKL000098, HKT000015. Status of the Estonian Licences can be checked here. Status of Kahnawake Licence can be checked here. Tonybet is also regulated by National Excise Licence Office in Ireland under reference number 1017899. All of the above are collectively mentioned as “Licences”.
1.2. By using, visiting and/or accessing any part (including, but not limited to, sub-domains, source code and/or website APIs, whether visible or not) of the Website or mobile application or any other websites or applications that Tonybet owns or operates, (the “Website”) and/or registering on the Website, You acknowledge that you have agreed to be bound by (i) these Terms & Conditions; (ii) General Betting Procedures, (iii) Bonus Terms, and (iv) the Rules applicable to our gaming products (hereinafter collectively referred as the "Terms & Conditions"), and are deemed to have accepted and understood all the Terms & Conditions.
1.3. When You register, access and play games and bets on the Website operating under the respective licences, You hereby agree to be bound by these Terms and Conditions, which may be amended from time to time, and are deemed to have read, understood and accepted all the Terms & Conditions which shall thereby govern Your actions and activities, and the relationship with Tonybet. These Terms & Conditions apply to the User playing under the Licences on the tonybet.com website.
1.4. You must read these Terms and Conditions carefully in their entirety. If You do not agree with any provision of these Terms and Conditions, You must not use or continue to use the Website.
1.5. If You have any questions regarding the Terms & Conditions, the Website, and/or the services, please contact our Customer Support team (see Clause 14 below for how to get in touch).
1.6. In the event of any discrepancies or inconsistencies between the versions of this document in any other language other than the English language, the English version shall prevail and shall be the authoritative text.
1.7. All material changes to the Terms & Conditions will be notified to You via an onsite notification on Your next login and/or via email notification. Your continued use of the Website, Your Account and/or any of the services following notification of any such change(s) will constitute acceptance of the Terms & Conditions as modified. If You do not agree to a material change to the Terms & Conditions, You should not continue to use the Website, Your Account or any of the services and You should contact our Customer Support so that Your Account can be closed and any deposited funds returned to You (subject to any rights we may have under the Terms & Conditions to withhold funds).
1.8. Tonybet may also from time to time make minor/non-material changes to the Terms & Conditions. These changes will not necessarily be notified to You and so You should check the Terms & Conditions regularly for any such changes. Your continued use of the Website, Your Account and/or any of the services following any such change(s) shall constitute acceptance of the Terms & Conditions as modified.
1.9. All monetary amounts stated herein are expressed in the following currencies BRL, CAD, CLP, EUR, NZD, USD, as specified. Any reference to an amount in one currency shall be deemed to refer to the equivalent amount in the other currency, calculated at the exchange rate in effect on the date of the relevant transaction or event.
1.10. The Service provision through the Website is determined as follows in respect to the Licences:
1.10.1. If You are logging from the following listed countries: Estonia, Finland, Luxembourg, Liechtenstein, New Zealand, Iceland, and Ireland (only for Casino Services), the services are offered under Estonian Licence.
1.10.2. If You are logging from the following listed countries: Canada (excluding Ontario), the Services are offered under the Kahnawake Licence.
1.10.3. If You are logging in from Ireland for Sports Book Services, the Services are offered under the Irish Licence. As referenced in Clause 1.10.1. Casino Services in the jurisdiction of Ireland is only offered to Players under the Estonian License.
2. User Registration & Account Rules:
2.1. For a person to be registered as the User with Tonybet and use the Website, that person must submit an application for registration and opening of an account via the Website (the “Account”). The application for the opening of the User Account must be submitted personally, and will require the following details, at least, will also be required in order for the person to be registered:
2.1.1. first and last name;
2.1.2. residential address;
2.1.3. mobile phone number;
2.1.4. valid email address;
2.1.5. Your password;
2.1.6. personal identification number; and
2.1.7. date of birth, thereby confirming the age of the User:
2.2. Where the information stipulated in Clause 2.1. is not provided and/or is not deemed to be complete, accurate, up-to-date at any point in time or have any signs of modification, does not correspond to the information obtained from a valid Identity document and/or other independent sources, Tonybet reserves the right to suspend the User Account registration, terminate the present contract and null and void all transactions and/or fortify and balance or winnings if such modification or provision of incorrect or incomplete information was done by the User. Where the Account is suspended, You should contact customer support on [email protected]. However, Tonybet reserves the right to refuse any application for the Account registration, re-opening at its sole discretion.
2.3. Users cannot create an Account under the name, account name or designation that is offensive, obscene, or indecent. Tonybet reserves the right to close such User Account on its sole discretion and fortify any balance from such an account as a breach of the current Terms and Conditions.
2.4. You must not use the Website if You are under the legal age for participation in gambling activities in Your country of residence (where applicable – under 18 years old, 19 years old for Canada and/or 21 years old for Estonia unless otherwise specified in the present Terms and Conditions or applicable laws and regulations). We may suspend Your account till the age is fully verified based on the documents provided and/or independent reliable sources of information. Subject to the provisions of Clause 2.12, any transactions concluded by the User who is in breach of Clause 2.1.7. and this Clause 2.4., will be considered null and void with all relevant legal consequences in relation to conclusion of invalid contract, deposits will be refunded to the last known payment method that belongs to User. If it is not possible to return money to the last verified payment method, the User will be contacted to provide proof of ownership of alternative payment method and the deposits will be returned there respectively. Moreover, Tonybet reserves the right to report the User to the relevant regulatory authority.
2.5. For Users that use the Tonybet Services under Kahnawake Licence as stated in Clause 1.10.2. in the present Terms and Conditions, any winnings won by a player under the approved legal age by participation in an authorized game, will be confiscated by Tonybet and forfeited to the Kahnawake Gaming Commission unless applicable laws dictate otherwise. The User shall only be entitled to the deposit amount.
2.6. A person maintaining a registration with Tonybet for the Account warrants and represents that any information provided in the application form is true, current, and correct. Tonybet will not register the person and, where that person has already been registered, Tonybet will cancel that User’s registration and Account if it reasonably suspects that the User has provided false or misleading information when registering as the User.
2.7. You may only open one Account. If Tonybet discovers that You have opened more than one Account, each such additional User Account shall be classified as a "Duplicate Account". Moreover, if Tonybet discovers that You hold one or more Duplicate Accounts, Tonybet will be entitled (in respect of each Duplicate Account):
2.7.1. to close the Duplicate Account, leaving You with only the original user Account (unless we have reason – for example if You have deliberately or fraudulently opened more than one active Account – to close all Your Accounts) and to treat all bonuses and any type of promotions, and all winnings accrued from such bonuses and any type of promotions, obtained using the Duplicate Account as void;
2.7.2. to void all unsettled and/or future bets/wagers made on the Duplicate Account; and
2.7.3. if Tonybet determines (acting at all times fairly) that the User has deliberately or fraudulently opened more than one active Account, to retain all or part of the positive balance of the Duplicate Account or all accounts created by the User.
2.8. It is the User’s responsibility to confirm that his/her gaming activities pursued, or attempted to be pursued on the Website is legal within the territory he/she resides in. The User only may use the Website if they are permitted to do so under the applicable laws of the jurisdiction in which the Website is being used. Tonybet does not provide any legal advice or assurance. It is the User’s own responsibility to comply with the applicable legal conditions at all times and to ensure that s/he is legally entitled to use the Website without restriction.
2.9. You are prohibited from selling, transferring, or acquiring User Accounts to or from other Users.
2.10. Funds cannot be transferred from Your User Account to the User Account of another User.
2.11. In registering for the Account, You warrant that You:
2.11.1. are acting on Your own behalf and not acting on behalf of another party;
2.11.2. have a full legal capacity;
2.11.3. are located in country as per information provided in Your User Account;
2.11.4. have not been excluded, and are not currently subject to a self-exclusion, from gambling, whether with Tonybet, any other gambling operator, and/or registered with national self-exclusion schemes;
2.11.5. have never been diagnosed with a gambling disorder, problematic gambling and are not undergoing/has not undergone treatment for problematic gambling behaviour;
2.11.6. will not conduct criminal activities through the Account;
2.11.7. will not deposit funds which originate from criminal and/or other un-authorised activity; and
2.11.8. You are not depositing or withdrawing money through a payment method which is not in Your name;
2.11.9. You are not depositing money through a business payment method (including but not limited to a business bank account or business PayPal account and etc.);
2.11.10. You have not previously held an Account which has been closed by us for any reason;
2.11.11. You have not been undergoing any treatment, diagnosed, recovered from any mental health disorder, disability or have had, having, or undergoing any treatment in relation any addiction including but not limited to alcohol or drug addiction; or
2.11.12. You will not be using Tonybet website under influence of drugs, alcohol, or any substances that and affect your decision-making abilities.
2.12. If we discover that any registration details provided by You are incorrect or misleading, we will either refuse the registration, or (where You have already successfully registered) we will have the right to suspend and, ultimately, close Your Account under Clause 2.13. below.
2.13. Tonybet reserves the right, at its own discretion, to:
2.13.1. refuse to open the User Account;
2.13.2. close an existing User Account in the event that the User is reasonably suspected of having engaged in fraudulent or unlawful conduct, conduct which is in breach of these Terms & Conditions or if that Your betting behavior represents an unacceptable risk to Tonybet;
2.13.3. refuse deposits, provided that any wagers, or any winnings, will be honored by Tonybet, provided they are not reasonably suspected as having been acquired by fraud or other illegal or illicit means;
2.13.4. suspend or cancel the User Account’s eligibility for promotional activities, competitions, or other services;
2.13.5. suspend the User Account, suspend the ability of User to deposit and/or gameplay temporarily for the period of internal investigation or permanently. The Suspended User account allows withdrawal respective the remaining User funds provided that such funds or User activity is not resulting from the criminal, fraudulent or illicit activity.
2.13.6. suspend and/or close the User Account, and/or fortify any winnings if a Player uses any information which has not been made public and, if it were made public, would likely to have a material effect on the relevant market relating to the event, or uses any information from Tonybet employees or ex-employees (‘Insider Information’).
2.14. If Tonybet reasonably suspects that there are legitimate concerns that:
2.14.1. the User has used their User Account for unlawful, fraudulent, or dishonest activities;
2.14.2. these Terms and Conditions have been directly or indirectly violated, which may include, amongst others:
2.14.2.1. the User has engaged in behaviour which attempts to cheat or manipulate the outcome of bet(s) on the Website;
2.14.2.2. Tonybet suspects that the User has deliberately cheated or has obtained an unfair advantage by using information which is not publicly available;
2.14.2.3. the User has attempted to wager in a pattern to identify advantageous betting methods or patterns inter alia including the usage of any artificial intelligence, program, bot, or any equipment;
2.14.2.4. the User has exploited, or attempted to exploit, an error, inclusive of a betting error, which illegitimately benefits the User;
2.14.2.5. the User has engaged in collusion;
2.14.2.6. the User has accessed and/or participated in gaming activity from a territory where such participation is prohibited by applicable laws & regulations or illegal;
2.14.2.7. the User has used or legitimately suspected to use the Website for money laundering, terrorism financing activity and the respective report was submitted to required Financial Intelligence Unit and/or enforcement authorities;
2.14.2.8. the User has used the Website for the purpose or as a result of match -fixing activities determined or confirmed by the reputable international bodies focused on integrity monitoring.
2.15. Tonybet reserves the right to decline a new User or close an existing User’s Account without notice, including but not limited to where Tonybet reasonably suspects that the User has engaged in fraudulent or unlawful behaviour or conduct which otherwise breaches these Terms and Conditions. In cases of fraudulent activity and Terms and Conditions breach Tonybet reserves the right to fortify any winnings resulted from such a contract breach or fraudulent conduct and/or take a legal action against such a User.
2.16. Tonybet reserves the right to forbid different Account holders from the same household (i.e., same IP address or same residence address) and/or family are betting on the same event/event outcome, including the betting on the same Event/Event outcome in different combination bets, to avoid the Terms & Conditions and/or exceed applicable limits.
2.17. Tonybet reserves the right to restrict access to Website for any User who breach the provisions of the Terms & Conditions or use Tonybet’s services in a bad faith manner. Any violation of these Terms & Conditions by the User may lead to reduction of betting limits, restriction of Accounts, confiscation of winnings, return of deposits or remaining balance in Account, as the case may be, and/or cancellation of all placed bets (even decided bets).
2.18. Tonybet reserves the right to impose any limits to the User account on own discretion including but not limited to deposit limits, wagering limits, loss limits, session or time limits, User access limits. User reserves the right to withdraw the account balance at any time through the website or by contacting the consumer support notwithstanding the account status provided that such a User account is not under investigation due to the illicit, criminal, or fraudulent activity.
2.19. Tonybet will report the User suspected of fraud or other unlawful, illicit, criminal actions to all relevant authorities.
2.20. Tonybet reserves the right to exclude any users from accessing the Website, where there is reasonable suspicion that their actions could cause damage to the interests of Tonybet or based on the regulatory enforcement or regulatory regime in a particular location.
2.21. The User collusion is strictly prohibited and Tonybet will take active measures in prohibiting the use of robots, artificial intelligence or other devices that distort the services offered by Tonybet. Tonybet does not accept bets where there is reason to believe that the User are acting in agreement, or as a syndicate. When syndicated bets are discovered, Tonybet reserves the right to cancel these bets.
2.22. In the event of reasonable suspicion of any User wrongdoings, for any reason included and not limited to actions stipulated in Clause 2.14 herein, money laundering activities, match fixing, terrorism financing, conflict of interest acting (or attempting to act) in any way which is reasonably deemed by Tonybet to be illegal in any applicable territory/jurisdiction, made in bad faith, or intended to defraud Tonybet and/or circumvent any contractual or legal restrictions (regardless of whether such act or attempted act actually causes Tonybet any damage or harm), Tonybet reserves the right to (as applicable):
2.22.1. request documents for verification of identity, the verification of ownership of payment method (including pre-paid cards), verification of source of wealth or source of funds or other facts provided by the User in relation to his/her User Account, before effecting and actioning withdrawal requests, deposit requests, at any point of time within the course of the contractual relationships;
2.22.2. hold and manage funds belonging to the User in his/her User Account in accordance with generally accepted guidelines for cash management. This may include a financial institution, or a payment solution provider being entrusted to hold funds in the name of or for the benefit of the User;
2.22.3. withhold funds available on the User Account, or refuse to honour a claim for payment of the User until such time as verifications or investigations are conducted to determine the actions of the User or confirm if possible potential violations of the User were conducted;
2.22.4. apply, retain or pay out any funds held by the User in the User Account in such manner as Tonybet may be ordered to do by any competent regulatory or other authority within the jurisdiction where the unlawful, fraudulent, or dishonest activity may take place or by which Tonybet is regulated; or
2.22.5 close or suspend the User’s Account at its own discretion at any time and without prior notice. The User will be notified by email about any such measure.
2.23. Your Account will be considered to be Inactive (the “Inactive Account”) when You do not log into Your Account for a period longer than 12 (twelve) consecutive months. Your account becomes dormant (the “Dormant Account”) if it remains Inactive for a continuous period of 24 (twenty-four) months. Subject to these Terms & Conditions, if Your account becomes Dormant, Tonybet will notify you via email with instructions on how to reclaim any remaining funds in Your account. Upon Your request, Tonybet will attempt to return the funds to the last payment method You used. However, for security reasons, Tonybet may need to verify your details before processing this request. It is Your responsibility to ensure that the contact details Tonybet hold for Your account remains up to date. If it is not possible to return the funds to Your last payment method, You will be required to provide details of a bank account in your name. We will verify these details before any funds are transferred.
2.24. If Your Account has been suspended for any reasons outlined by Tonybet (the “Suspended Account”), Tonybet closes or suspends Your account for any of the reasons referred to in Clause 2, the User shall be liable for any and all claims, losses, liabilities, damages, costs and expenses incurred or suffered by Tonybet (together “Claims”) arising therefrom and shall indemnify and hold Tonybet harmless on demand for such Claims. In the circumstances referred to in Clause 2.14., Tonybet shall also be entitled to withhold and/or retain any and all amounts which would otherwise have been paid or payable to You (including any winnings, bet credits or bonus payments).
2.25. If You proceed to close Your Account with Tonybet (the “Closed Account”), the available funds in the Closed Account will be remitted to You, if remittance is possible in accordance with due diligence procedures and these Terms & Conditions. No fee will be charged for the closure. Tonybet will remit the funds to Your last used verified payment method within a reasonable time upon Your User Account becoming the Closed Account, subject to satisfactory completion of due diligence procedures and these Terms & Conditions. Any outstanding bets at the time of the closure of the account will not be honored.
2.26. As from when the User Account becomes the Suspended Account or the Closed Account, the User shall no longer maintain the right to claim or receive any winnings, if the entitlement to any winnings arose after the User Account was converted into the Suspended Account or Closed Account. Accordingly, the User shall not be entitled to claim or receive any winnings even if the winnings have not yet appeared in the User Account prior to it being converted into the Suspended Account or the Closed Account. The User shall be prohibited from making any claim to receive such winnings.
2.27. Tonybet warrants to:
2.27.1. manage funds belonging to the User in a secure and appropriate manner; and
2.27.2. manage data pertaining to the User in accordance with applicable law, and data protection regulations.
2.28. If Tonybet mistakenly credits Your User Account with winnings or bonus money that do not belong to You, whether due to an error (whether human or technical), the amount will remain the property of Tonybet, and the amount will be deducted from Your Account (if possible). In the event of an incorrect crediting, You are obliged to notify and contact Tonybet customer support via email at [email protected] immediately.
2.29. Employees of Tonybet, employees of the service providers with valid contractual relationships with Tonybet (or employees of a member of any such service provider’s corporate groups) are not eligible to use Services through Website.
2.30. You will not try to sell or in any way transfer or seek to transfer, whether directly or indirectly, Your funds from Your Player Account to the Player Account of another Player for any reason.
3. The User’s Verification:
3.1. All Players should be over the legal age based on the applicable laws as per the country of residence (21 +, 19+ or where applicable – 18 years old).
3.1.1 The User is hereby notified that Tonybet carries out verification procedures, whether itself or through third parties on players depositing money. You hereby acknowledge that Tonybet may disclose, transfer, and share Your personal data with any third-party company that Tonybet may choose from time to time that provides such a service as more fully detailed in Tonybet’s Privacy Policy. You will be requested to provide Tonybet with documents, including but not limited to, a copy of the passport or ID card, proof of home address, proof of ownership of the financial instruments used. Tonybet reserves the right to perform additional security checks, which may include but are not limited to requesting additional documentation, and other means of verification. Your User Account may be blocked or closed if the User does not provide requested information or documents or if such information or documents the User supplies is/are found to be false or misleading.
3.2. You agree that from time to time, upon our request, You may be required to provide us with valid identification documents and/or other documents/information so that we can carry out the identification, credit, and other verification checks. You agree to provide documents used for the verification of your User Account once the validity of such a document expires. You agree to provide all such requested documents/information and You accept that, until we have received the requested documents/information and satisfied the checks to our reasonable satisfaction, we are entitled to suspend Your Account in any manner that we reasonably deem appropriate, including by preventing You from placing any bets or wagers, or temporarily from withdrawing Your funds. If our checks cannot be completed to our reasonable satisfaction, we will ultimately close Your Account and pass on any necessary information to the relevant authorities.
3.3. The information/evidence that we may request may include (but are not necessarily limited to) certified ID, proof of address, passport and bank statements (noting that redacted copies of any such information/evidence may not be accepted), and we may also require You to provide a photograph of Yourself holding these documents or request video verification and “liveness check”. Occasionally, we may require You to provide either a certified or notarized copy of Your documents. Tonybet reserves the right to use independent sources to conduct consumer research and confirm the trustworthiness and validity of the provided information or documents.
3.4. An Account may be opened to persons who are over twenty-one (21) years old (in Canada, eighteen (18) years old or nineteen (19) years old, depending on their province of play). A person must be at least twenty-one (21) years old to play casino Games of chance (In Canada, eighteen (18) years old or nineteen (19) years old, depending on their province of play) and at least eighteen (18) years old to play Toto/Sports booking.), unless different legal age is applicable to specific types of games under the country or residence of the User.
4. Deposits:
4.1. Deposits will be credited to Your Account after we have processed and cleared them. You can use the money deposited into Your Account to place bets and/or play games as part of the services.
4.1.2. The minimum deposit amount through the Website is €10.00 or any amount linked with the corresponding payment method used. There are no processing fees applied by Tonybet in relation to using any payment service provider unless your bank or your payment account provided requires so. Maximum deposit amounts can be enforced by the payment service provider used for such a deposit.
4.1.3. Depending on the method selected, deposits can incur charges. For current fees regarding depositing funds, refer to the Payment Methods page of the Website. Your bank may independently charge You for bank wire transfers and other methods of payment. Tonybet accepts deposit methods that are published on the website depending on the User location.
4.1.4. To proceed with refund, You should contact [email protected], the refund can be processed only from the verified Account. In all cases, identification procedure may be required (if You are unverified User), in this case, You may be asked to provide verification documents: passport, copy of ID and proof of payment (photo of the credit card (all sensitive data must be covered), bank statement, full screen screenshot of the wallet. We reserve the right to withhold the cost of the charged refund fee for the processed amount as fixed per payment provider.
4.2. Tonybet reserves the right to refuse or reject the deposit, payment or wager until the User identity and/or ownership of the deposit method is verified, as per Tonybet’s sole discretion.
4.3. Tonybet does not accept third party deposits. The User must make deposits only from a bank account, bank cards VISA/MasterCard (cardholder's responsibility to know the laws concerning online gambling in his or her country of domicile), payment systems Skrill/NETELLER or other payment wallets/payment options that is registered in the User’s own name (it is forbidden to make deposits using someone else’s electronic wallet. Tonybet has the right to return funds to the holder of such electronic wallet without prior notification and consider the transaction in crediting or debiting money to or from User account as null and void, including seizure of any winnings) as well as to close the User Account.
4.3.1. You further understand, agree and acknowledge that if, at any time whatsoever, Tonybet has reason to believe that You have used any kind of payment method belonging to any third party, Tonybet reserves the right, at its own discretion, to suspend Your Account pending a complete investigation in relation to potential deposits, whether directly or indirectly, effected to Your Account using payment belonging to any third party. Such activity will be deemed as constituting a violation of the Terms & Conditions amounting to fraud, and by extension Tonybet reserves the right, at its own discretion, to close Your Account and/or reverse or adjust any transactions, forfeit funds deposited and/or winnings generated from deposits effected to Your Account using credit cards; Moreover, You waive any and all right(s) to claim for any related shortcomings.
4.4. Tonybet may use third party payment service providers (“PSPs”) to process deposits and withdrawals from Your Account as well as to verify your identity or ownership of your payment account. You authorize us to use PSPs, as necessary, to process transactions. Tonybet does not take responsibility for any delays caused due to its payment system or due to delays caused by any third party.
4.5. You acknowledge and understand that Tonybet is not a bank or financial institution, and the balance held in Your Account will not earn interest in Your favour. Tonybet does not offer any credit facilities.
4.6. If Your country imposes any taxes and duties on deposit transfers, You should solely be responsible for payment of such taxes and duties.
5. Withdrawals:
5.1. Tonybet will not charge You any fee on bank wire withdrawals. However, You are advised to check with Your bank as to whether they will impose any such charges. Tonybet will not be responsible for any commissions applied to You as this is beyond our control. However, You might be asked to request Your accumulated withdrawals in a few split transactions due to the mandated card or payment service provider restrictions.
5.2. You may withdraw as many times as You wish, provided that:
5.2.1. all payments made into Your Account have been confirmed as cleared and have not been charged-back, reversed or otherwise cancelled;
5.2.2. any verification checks to our reasonable satisfaction (see Clause 5.5). Where we have requested information from You to carry out the verification, any delay in providing this information may cause an additional delay when withdrawing funds; and
5.2.3. there is currently no ongoing, or completed, investigation:
5.2.3.1. into an Error, Malfunction or Interruption (as those terms are defined in Clause 10.7.1 below) involving a service which You have played/wagered on or participated in; or
5.2.3.2. where we have reason to believe You may have engaged in any illegal activities or the Account rules (defined in Clause 2) which would entitle us to withhold funds in accordance with Clause 2.24,You acknowledge and understand, as we made clear in the these Terms and Conditions, that we will void any affected transactions, withhold and/or retain relevant/attributable winnings, and (in the case of the Account rules defines in Clause 2) suspend and (if applicable in the circumstances) ultimately permanently close Your Account with us.
5.3. In addition to identity documents, Tonybet may also ask You to provide source of funds and/or source of wealth documents such as bank statements, employment information, tax declarations and any other information relevant to Your financial status. Tonybet may also carry out additional due diligence checks, and Tonybet may also request further due diligence documentation from You. All transactions will be checked to prevent money laundering and terrorist financing.
5.4. Tonybet will contact You to provide due diligence documentation. You should always blank out sensitive and confidential information. Tonybet will process the withdrawal once satisfactory proof has been received.
5.5. Please note the following:
5.5.1. Wherever possible, we will process Your withdrawals using the same payment method You used to make Your last deposits. Where we are unable to do so, we may contact You to request alternative payment details from You. Withdrawal payments may only be made in the name of and to the registered Account holder. If a third-party payment is made to the account, the payment should be reversed to the owner of the payment method or to the funding source account;
5.5.2. withdrawal by wire transfer can only be made to a bank account in Your name;
5.5.3. we do not offer withdrawal by cheque;
5.5.4. winnings cannot be transferred, substituted, exchanged, or redeemed for any other prize.

All withdrawals will be processed by Tonybet as soon as possible, however, not more than within 5 (five) working days since the withdrawal request unless additional verification as per current Terms and Conditions or applicable law is required provided that User Account is not under ongoing investigation in relation to breach of the current Terms and Condition and any suspicion in relation to fraudulent, illicit or criminal activity are cleared.
5.8. You should solely be responsible for any tax that may be imposed on withdrawal in Your country. 6. Placing Bets/Wagers:
6.1. Once You have confirmed Your bet or wager the value of Your stake will immediately be deducted from Your Account balance. 6.3. Tonybet reserves the right to decline any bet/wager, in full or in part, at its sole discretion. Tonybet reserves the right to cancel any placed bet/wager by the User on its own discretion by determining the transaction as null and void including but not limited to cases of full or partial Service interruptions and/or unavailability of the Website. Tonybet does not accept bets from active athletes on the sport events that are concluded with participation of such athletes. In such a case Tonybet reverts the amount of the bet on the User account and fortify any the possible winnings from such a bet.

Limits
7.6. Tonybet offers the option to set Loss or Deposit Limits. If You set different limits on overlapping / concurrent periods, the lowest limit will be applied. Time-Out
7.7. If You wish to take a ‘Time-Out’ or break from gambling for a short period, You can contact our Customer Support representatives via our 24-hour Live Chat or Email. You can choose between 24hrs, 1 week, 1 month, 6 weeks or 3 months. During the Time-Out period, You will not be able to place bets or engage in gambling from our site.

12. Security Rules:

12.7.1 A “Malfunction” refers to where an automated process fails to operate as designed or intended, for example where a piece of computer software produces a deviation from its intended performance specifications or parameters, where two or more pieces of software fail to interface or communicate with each other in the manner intended or designed, or where an incorrect or out-of-date version of a piece of software becomes available or accessible to players, in any such case so as to produce a result which is not the result that was intended or designed. These malfunctions may or may not be apparent to us or to You and they may only become known as and when settlement instructions, game outcomes, winnings or cashouts are investigated and analysed retrospectively.
12.7.2 An “Error” refers to a mistake or error that is not exclusively technical, for example the mistaken posting of incorrect odds, the offer of incorrect prices or terms for participation in a Promotion or gambling opportunity. Tonybet reserves the right, at its own discretion, to cancel, reverse or adjust any transactions and/or forfeit funds due to any: “Malfunction”, Error, Interruption, Force Majeure; Violation of the Terms and Conditions; collusion, game faults or abnormalities; unintended use of bonuses or promotions, including those caused or actioned by the User and/or by the Tonybet system; promotions, rewards or incentives of a similar nature and/or criminal actions.
12.9. Tonybet does not acknowledge or accept any liability whatsoever for damages to the User and/or a third party caused directly and/or indirectly due to any:
12.9.1. Technical Failure, Malfunction, Interruption, Error, or Force Majeure;
12.9.2. violation of the Terms & Conditions;
12.9.3. collusion and/or criminal actions;
12.9.4. financial risk and loss; and/or
12.9.5. legal and financial actions and/or other remedies taken against the Participant and/or a third party.
12.9.6. If, as a result of a Malfunction, Your Account is credited with winnings that You would not have received were it not for that Malfunction, we will have the right to void the relevant Transaction and withhold the relevant winnings. This applies even if the relevant gambling product could have produced the same or similar amount of winnings without the intervention of the Malfunction and it applies whether the Malfunction was apparent to You or to us or not. If You have withdrawn any such winnings, You agree that You will pay them back to us as and when we ask You to.
12.9.7. 12.11.3. for games where there are multiple stages or decision points, we will take all reasonable steps to restore the game to its last known state prior to the Interruption to enable You to complete the game;
12.11.4. for games with multiple participants (equal chance or otherwise), we will deal with these as seems fairest to us (acting reasonably) on a case-by-case basis; and
12.12. Where any Malfunction, Interruption, Error is/are or becomes apparent or obvious to You or You suspect that Malfunction Interruption, Error may be occurring, You agree that You will cease Your use of the relevant Service(s) immediately and will report it to our Customer Support immediately via email [email protected].
13. Complaints:
13.1. If You have a complaint, You can e-mail our Customer Support Service on [email protected].
13.2. Tonybet will do its best to provide You with an outcome of the complaint within 14 (fourteen) calendar days from the date on which the complaint is received. In cases where the complaint requires more time for it to be addressed, such a period may be extended by a further 14 (fourteen) calendar days.
13.3. Complaints are handled in the Customer Support department and may be escalated within Tonybet organisation in cases where the Customer Support personnel do not solve the case immediately. The User shall be reasonably informed about the state of their complaint. We always endeavor to resolve complaints in the least time possible.
13.4. If for some reason You are not satisfied with the resolution of Your complaint with regards to online games by Tonybet, You, can complain to any independent body such as an independent arbitration service, gaming authority or the licensing regulator as applicable:

13.5. The User confirms that he/she is solely responsible to check the complaints acceptability timelines with the respective authorities and the applicable law.

14. Communication with Customer Support:
14.1. When the User contacts us, the User will not make statements which:
14.1.1. Are sexually explicit or grossly offensive;
14.1.2. Use derogatory terms and/or incite hatred; or
14.1.3. Are abusive, defamatory, or otherwise harasses, threatens, or causes distress or inconvenience to our Customer Support Service agents.
14.2. Tonybet may record or keep copies of all communications that You have with our Customer Support Service agents.
14.3. Tonybet may provide the User with a chat facility to talk to other users. When contacting each other, the User shall not make statements or transmit content which:
14.3.1. Are sexually explicit or grossly offensive;
14.3.2. Uses derogatory terms and/or incite hatred;
14.3.3. Encourages or facilitates any illegal activities;
14.3.4. Harasses, threatens, or causes distress or inconvenience to other users;
14.3.5. Influences other users' actions through intimidation or abuse;
14.3.6. Disrupts the normal flow of dialogue, make statements that are abusive, defamatory, harassing or insulting to users of the Website;
14.3.7. Advertise, promote, or otherwise relate to any other online entities including forums;
14.3.8. Is about the Website, or any other Internet site(s) connected to the Website and is untrue and/or malicious and/or damaging to the Website; or
14.3.9. Any suspicious chats will be reported to the relevant competent authority.
14.4. Tonybet reviews all chats and keeps a log and record of all statements. Your use of the chat facility should be for recreational and socialising purposes only.
14.5. If You breach any of the provisions relating to the chat facility, Tonybet may remove Your access to the chat room or immediately close Your Account. If Tonybet takes such measures, Tonybet shall refund any funds which may be in Your Account except for funds which may be owed to us (if any).
14.6. Tonybet will not be liable if damage arises out of such chat functionality. You agree to compensate us against any damage arising out of Your illegal, unlawful, or inappropriate conduct or that constitutes a violation of these chat rules.

17.1. Where recourse to the National Law Courts is necessary (depending on Your jurisdiction), that National Court shall have exclusive jurisdiction without prejudice to other competent Courts and applicable National Laws.
17.2. For the User playing and using the services and Website under the Estonian Licence, these Terms and Conditions shall be governed by the Laws of Estonia. For the User playing and using the services and Website under the Irish Licence, these Terms and Conditions shall be governed by the Laws of Ireland. For the User playing and using the services and Website under the Kahnawake Licence, these Terms and Conditions shall be governed by the Laws of Kahnawake.
17.3. The User and Tonybet agree that any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the Courts of Kahnawake, the Estonian, or Irish courts depending on the applicable laws as per Clause 17.2. of these Terms and Conditions.
